International Divorce and Family Law: Pakistan & England
Expert English family law advice for individuals and families who have a connection to Pakistan.
When a relationship ends, the practical questions are often close to home: where can the divorce take place, what happens to the house and how will a child keep seeing both parents? The Pakistani connection may affect the evidence and the options, even if nobody has started proceedings abroad.
This page may be relevant if you are a:
- Pakistani national living in England or Wales who is considering divorce or separation
- British person married to a Pakistani national, or a couple married in Pakistan who now live in England
- Family that has moved between the two countries, including British expatriates in Pakistan
- A parent whose child travels between England and Pakistan or whose former partner lives abroad
- Spouse with a home, land, business, bank account, or family wealth in Pakistan
- Someone with a Pakistani marriage or divorce document who needs to understand its effect in England and Wales
Laurus advises on family law in England and Wales, and can assess whether an English court may deal with your divorce, financial claims, or arrangements for children and identify where Pakistani legal advice is also needed.
Divorce involving England and Pakistan
The country where you are married does not dictate where you must divorce; however, a British passport alone does not establish the English court’s authority. Rather, it is concerned with where each spouse lives, habitual residence, domicile and other relevant connections.
If an overseas process has started or a divorce has already taken place, its nature, documents and legal effect need closer examination.
A nikah nama, a certificate, a notice of divorce, and a court order may record different events. A family may have been told that a religious divorce is complete while the question of its civil effect, or its recognition in England and Wales, remains unresolved. Laurus can review the English position and arrange for Pakistani advice on the process used there. This matters before either spouse assumes they are free to remarry or that financial claims have ended.
Which court can deal with the case
Some families have a clear centre of life in England, despite strong ties with Pakistan, while others have recently moved, live apart in different countries, or have already taken legal steps abroad. In those cases, the dates and sequence of events matter, and we may need to consider residence history, the status of an overseas marriage or divorce, any existing proceedings and what the court’s eventual order could achieve in practice.
The location of a child or a valuable asset does not, by itself, answer the divorce jurisdiction question. It may nevertheless shape the advice about related proceedings and enforcement. We help clients distinguish those issues, gather the records that establish their connections, and make an informed decision before an application is issued.
Financial settlements and property in Pakistan
Where an English court deals with financial claims, both spouses are expected to give full and frank disclosure of their income and assets, including resources held outside England and Wales.
Some couples have made promises about mahr (or mehr), sometimes called dower (dowry), in their marriage documentation. Its wording and enforceability should be considered in context, and it should not be assumed either to replace an English financial settlement or to have no relevance to it. We can assess its potential English significance with appropriate advice on the underlying Pakistani document.

Agreements before or during marriage
A couple expecting to live in England with family property in Pakistan may consider a pre or postnuptial agreement. Another couple may already have terms in a nikah nama or a later family agreement.
In England and Wales, fairness, free choice, understanding and each person’s needs remain important; an agreement cannot remove the court’s power to make a financial order. Independent advice in each relevant jurisdiction, careful disclosure and enough time to consider the terms can make the intended arrangement clearer.
Children travelling or living between England and Pakistan
A workable child arrangements plan needs to cover more than the number of weeks away; parents may need to agree who holds travel documents, how flights are booked, who pays, how the child communicates with the parent at home, and what happens if plans change.
A permanent move differs from a holiday. If one parent wishes to take a child from England to Pakistan, or return from Pakistan to England, advice should be taken before tickets are bought or a school place is surrendered. The child’s habitual residence, the adults’ parental responsibility, any existing orders, and the other parent’s consent may all matter.
Where a parent fears that a child may be taken or kept abroad without consent, urgent advice can help identify protective options in England, including a prohibited steps order. The routes available after a child is removed depend on the countries involved and the particular circumstances. Pakistan is not listed as a party to the 1980 Hague Child Abduction Convention, so parents should not assume that the Convention’s return procedure will apply between the two countries. Prompt coordination with a lawyer in Pakistan would be essential.
Important features of family law in Pakistan
For Muslim marriages, the nikah nama may contain terms that become relevant during separation, while divorce can involve notices or family court proceedings depending on how it is pursued.
This is particularly important when someone presents a religious ceremony or divorce as though its English civil effect is self-evident. The right starting point is to obtain the marriage records and an accurate account of where the parties were living at the relevant time.
